The Pakistan People’s Party (PPP) and the Pakistan Muslim League-Nawaz (PML-N) have raised concerns over several provisions in the Jamiat Ulema-e-Islam’s (JUI) draft proposal for the 26th constitutional amendment.
Both parties disagree with key elements of the proposed amendments, though efforts for consensus continue as per AzaadDigital.
Joint effort on constitutional amendment
The PPP and JUI have jointly prepared a draft for the 26th constitutional amendment and are working towards unifying all political stakeholders.
However, disagreements have emerged, particularly over the JUI’s proposals related to judicial reforms.
Key proposals in JUI’s draft
The JUI’s draft suggests establishing constitutional benches in both the Supreme Court and high courts to handle constitutional disputes.
The Supreme Court’s bench would include the Chief Justice along with the five senior-most judges, while high courts would have a similar structure, with three senior judges alongside the Chief Justice.
Another critical proposal in the draft is the restoration of specific provisions from the 18th Amendment, particularly concerning judicial appointments. Furthermore, the JUI has called for amendments to Article 175-A and the cancellation of the 19th Amendment, alongside changes to Article 184/3, adding a sub-clause to enhance its interpretation.
Political reservations
Despite these comprehensive proposals, the PPP and PML-N have not aligned with all aspects of the JUI’s draft. However, discussions are ongoing, and all parties aim to agree on the amendment that serves Pakistan’s best interests.
