ISLAMABAD: The Supreme Court of Pakistan has rejected a plea filed by the former chief justice of Pakistan (CJP) Jawwad S Khawaja seeking the postponement of hearings on appeals against the nullification of civilian trails in military courts.
The former chief justice in his plea argued that a decision on the 26th Constitutional Amendment is vital before proceeding with the appeals regarding military courts. He appealed to the top court to halt hearings on intra-court appeals against military court decisions.
Supreme Court’s constitutional bench, led by Justice Amin-ud-Din Khan, heard the plea.
During the hearing, Justice Jamal Khan Mandokhail remarked that the request for a delay seemed to be motivated by personal interests, noting that Khawaja did not have any family members under custody.
Justice Jamal Mandokhail remarked that the Supreme Court functions under the current constitutional framework, with all benches being constituted under the amended constitution.
He further clarified that the case challenging the amendment itself would also be heard by a bench formed under the 26th Constitutional Amendment.
The top court rejected Khawaja’s plea and imposed the fine.
